In this case, the product is deemed dangerous in such a way that its user must take special precautions that have not included in the instructions when they go about using the item.Except in the case of defective medications, victims of defective products must be able to identify the parties responsible for manufacturing or supplying the product.

In product liability lawsuits, a number of parties can be held responsible, including:


  • The manufacturer of the product
  • A manufacturer of certain parts of the product
  • The assembler or installer of the product
  • The product wholesaler
  • The retail store from which the customer bought the product
